- On August 26, 2015, the CA Department of Water Resources (DWR) and the U.S. Bureau of Reclamation (USBR) submitted a SWP/CVP water rights change petition to the State Water Resources Control Board (SWRCB) to authorize the installation of three new diversion intakes on the Sacramento River, each with a diversion capacity of 3,000 cfs for a total of 9,000 cfs. This is one of the initial steps necessary for the CA WaterFix to proceed with its preferred Alternative 4A to export water from the north Delta. The SWRCB has not announced dates for any hearings to demonstrate that the change will not injure any legal user of the water involved, but their website has a Facts Sheet to provide some preliminary details regarding petition process and relationship to the update of the Bay-Delta Water Quality Plan which is currently underway. They say future information will be provided regarding how the public can provide input on this petition, but does anticipate that it will notice an evidentiary hearing where parties will have the opportunity to present evidence and argument about whether and under what conditions the petition should be approved. The public record for the hearing would then serve as the basis for the SWRCB's decisions regarding approval of the petition authorizing the project.
- DWR released a revised EIR/EIS for BDCPwith three new alternatives added, including a new modified Preferred Project (Alt. 4A), which are being recirculated for public review with deadline to submit comments by August 31, 2015. Alternative 4A (CA WaterFix), replaces Alternative 4 as the State's Preferred Project, and reflects the Governor's recent announcement to separate the conveyance facilities and habitat restoration measures into two individual efforts: CA WaterFix and CA EcoRestore. Two public meetings will be held in an Open House format, which means there will not be any formal presentations or panels to receive public comments, but informational exhibits and project team members will be present to answer questions. In addition to being available online, a hard copy of the revised EIR/EIS can be found at numerous locations throughout the State, or you can request a DVD copy by emailing BDCPComments@icfi.com.
