Our Contract

Purpose

The North Delta Water Agency and the CA Department of Water Resources (DWR) signed a contract in 1981 that assures a dependable water  supply of certain quality for water users in the north Delta.​

Subcontract

All lands within the NDWA boundaries are covered by the 1981 Contract, which allows landowners to also record those assurances on their property via a Subcontract. See below to download a copy of subcontract and for more information on purpose of Subcontract and instructions.   NDWA will record the Subcontract with the County and mail back the original to you, send a copy to DWR, and keep a copy in the Agency's files (this process can take 4-6 weeks).

DON'T FORGET TO:

  • Have a Notary Public witness your signature and send this form with the Subcontract to NDWA.
  • Attach a legal description of the property that appears on your deed with the parcel number(s) as "Exhibit A."

State Statutes

In 2013 the Delta Watermaster released a report describing the various state laws enacted to protect water rights (availability and quality) in Northern California and the Sacramento-San Joauquin Delta.  They were enacted during the formation of the CVP and SWP reservoirs and conveyance facilities to provide statutory assurances to Norther California and Delta water users that their local water supplies would not be depleted by the operation of the CVP and SWP water supply projects.  The dates of when these laws were adopted is key to understanding why they were enacted.

  • ​The 1931 County of Origin Act (Water Code Sections 10500-10506)​ - Enacted in response to laws adopted in 1927 that authorized the State to file applications to use unappropriated water  for water resource development projects that would export huge volumes of water from areas of abundance in Northern California to areas with water need. 
  • ​The 1933 Watershed Protection Act (Water Code Section 11460-11465)
  • ​The 1959 Delta Protection Act (Water Code Sections 12200-12205)
